Welcome to MithMill. These Terms of Use govern your access to and use of mithmill.com and our cold email marketing services. By using our services, you agree to these Terms.
1. Acceptance of Terms
By accessing or using our services, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms.
2. Services Provided
MithMill provides cold email marketing services, including domain setup and configuration, email inbox creation and management, inbox warm-up services, campaign infrastructure setup, and performance tracking and reporting.
3. Account Registration
To use our services, you must create an account. You agree to provide accurate, current, and complete information; keep your login credentials secure and confidential; notify us immediately of any unauthorized account access; and be responsible for all activities under your account.
4. Acceptable Use
You agree NOT to use our services to send spam, illegal, or unsolicited bulk messages outside agreed campaign parameters; promote illegal products, services, or activities; distribute malware, phishing content, or fraudulent material; violate applicable laws including UK GDPR, CAN-SPAM Act, or similar regulations; harass, threaten, or harm any individual or organization; or reverse-engineer, copy, or resell our services without authorization. Violation of acceptable use may result in immediate account suspension or termination without refund.
5. Payment and Billing
All fees are billed according to your selected subscription plan. Payments are due in advance and non-refundable except as outlined in our Refund Policy. We reserve the right to change pricing with 30 days’ notice. Failed payments may result in service suspension. You are responsible for any taxes applicable to your purchase.
6. Subscription and Cancellation
Subscriptions automatically renew at the end of each billing cycle. You may cancel your subscription at any time through your account or by contacting support. Cancellation takes effect at the end of the current billing period. No refunds are provided for renewal payments.
7. Intellectual Property
All content, branding, software, and materials provided by MithMill are the exclusive property of MithMill and are protected by intellectual property laws. You may not copy, modify, distribute, or use them without our written permission.
8. User-Provided Content
You retain ownership of content you provide for campaigns. By providing this content, you grant us a license to use it solely to deliver our services. You warrant that you have all necessary rights to use such content.
9. Service Availability
We strive to maintain service availability but do not guarantee uninterrupted access. We are not liable for downtime caused by maintenance, third-party providers, or force majeure events.
10. Limitation of Liability
To the maximum extent permitted by law, MithMill shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruption. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.
11. Disclaimer
Our services are provided “as is” without warranties of any kind. We do not guarantee specific results from cold email campaigns, including reply rates, conversion rates, or revenue.
12. Termination
We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use our services ends immediately.
13. Indemnification
You agree to indemnify and hold MithMill harmless from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
14. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of the United Kingdom.
15. Changes to Terms
We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.
